Common areas of gynaecological negligence include unnecessary hysterectomy, poor positioning during lithotomy procedures and surgical error.  

Many women experience vaginal tears, pelvic floor damage and other perineal trauma during childbirth. These injuries can cause ongoing problems for women, especially later in life. Poor management of vaginal tears including inadequate repair may give rise to a claim for negligence.

The fact that injury or a poor outcome has occurred is not sufficient to establish negligence. To succeed in negligence an individual must be able to demonstrate that the injury occurred because  the surgery did not comply with accepted standards of practice.
