An amputation can give rise to a claim in negligence if it can be shown that the amputation was the result of a preventable error during a surgical procedure or a there are serious complications after a misdiagnosis leading to amputation.

Amputations are performed when there is no possibility of restoring blood flow in arteries or veins in limbs or when there is an extensive, life-threatening, infection that antibiotics can’t control such as in the case of sepsis or necrosis.

As the mortality rate after amputation is high, it is important that patients, where possible, are as well as possible prior to surgery. Poor survival rates are also a factor in determining damages or costs of care after leaving the hospital in medical negligence cases.
