The NSW Civil and Administrative Tribunal (NCAT) published its full decision on October 9 in the case brought by the Health Care Complaints Commission (HCCC) against Dr Gayed. The NCAT hearing was held in June but Tribunal’s full findings were not published until now. It found Dr Gayed guilty of professional misconduct in all seven cases, and determined were he still a registered medical practitioner, the tribunal would cancel his registration. The tribunal disqualified him from being registered as a health practitioner for three years.

The full decision shows Dr Gayed had a comprehensive history of performing surgeries riddled with complications meaning there may be many more women who wish to make complaints against him. The details make very sobering reading and it is inexplicable how such a dangerous doctor was able to continue operating on women for such a long time, despite the fact that his employers were aware that he had made a number of serious mistakes. These mistakes had catastrophic consequences on the lives of many of his female  and infant patients.

Patient safety should be the paramount concern of the medical profession and the NSW Health Service. Immediate steps need to be taken to ensure that patients are protected from incompetent and dangerous medical professionals so that this situation does not happen again. NSW Health has appointed senior barrister Gail Furness to independently investigate Dr Gayed and the management of complaints against him. Her report is due on October 31.
