Our health law team helped a Sydney pharmacist successfully respond to complaints made against him by the NSW Health Care Complaints Commission (HCCC).
The Accredited Pharmacist, with more than 20 years of experience, was convicted on two counts of recklessly importing tier 1 goods, (Testosterone Benzoate and Testosterone Enanthate) without a permit, and for professional misconduct relating to a failure to notify the National Board about the convictions in the NSW District Court.
Our client had no prior convictions and the charges stemmed from a misunderstanding about the rules concerning the importation of restricted drugs.
He was intending to develop testosterone-based products to alleviate age-related concerns. In particular, he was experimenting with dissolving testosterone in certain oils, rather than water, so that he could create a more effective anti-ageing injectable.
He thought he could import testosterone for “cosmetic” purposes, and unfortunately, failed to make the relevant enquiries. Read the decision here.
What did we do?
The HCCC reviews complaints and investigates misconduct in accordance with the Health Care Complaints Act 1993. Our client was at risk of being deregistered as a pharmacist.
We helped him to understand the HCCC process and to draft his response to the Commission.
The result
Whilst he was reprimanded, and has a number of conditions upon his registration, our client can continue to work as a pharmacist.
We have helped and encouraged our client to use the process to improve his procedures.
