You do need to know that there are time limits in this area of the law. In NSW, a person intending to make a claim has just 12 months from the date of death to lodge a contested estates claim. It is possible to seek an extension of time but the Court will only extend time if there is a sufficient reason for the delay in bringing the claim. You can’t assume that an extension of time will always be granted.
The 12 month period from the date of death is not long and can pass very quickly. We strongly recommend seeking legal advice as early as possible and certainly well before the 12 month period is about to expire.
We appreciate that taking that first step can be very difficult in a time of grief but you need to act to ensure your rights are protected. Also, action needs to be taken before the executor has a chance to distribute the estate to named beneficiaries. This can happen well within the 12 month period.
