Will disputes? How to contest an estate

Do you have a will dispute or need advice about how to contest an estate?

It can be traumatic to learn that you have been left out of a will or not been adequately provided for. The legal process can seem daunting and particularly so when you are grieving the loss of a loved one.  Our Wills and Estates law team acts not only for people making a claim but also for those defending them.

We can give you a quick and obligation free assessment of your situation. You will be advised of any potential entitlements and what steps you need to take next.

Will dispute or contested estate

You do need to know that there are time limits in this area of the law. In NSW, a person intending to make a claim has just 12 months from the date of death to lodge a contested estates claim.  It is possible to seek an extension of time but the Court will only extend time if there is a sufficient reason for the delay in bringing the claim. You can’t assume that an extension of time will always be granted.

The 12 month period from the date of death is not long and can pass very quickly. We strongly recommend seeking legal advice as early as possible and certainly well before the 12 month period is about to expire.

We appreciate that taking that first step can be very difficult in a time of grief but you need to act to ensure your rights are protected. Also, action needs to be taken before the executor has a chance to distribute the estate to named beneficiaries. This can happen well within the 12 month period.

Call our Wills and Estates team on either 02 4929 3995 or 1800 874 949, or you can email us on info@catherinehenrylawyers.com.au
